Equitable developer to pay $500,000 asbestos fine

admin — Wed, 05/06/2009 - 15:00

  • Des Moines developer Bob Knapp has agreed to pay a record $500,000 fine for mishandling health-threatening asbestos at the historic downtown Equitable Building.
  • Bob Brammer, spokesman for Attorney General Tom Miller, said the civil fine for Equitable LP is by far the largest ever assessed in Iowa in a civil case involving asbestos work.
  • "With the foreclosure action coupled with this, hopefully, a bright future is ahead."Heitzman, who paid for tests that showed no asbestos in his store, said the state's asbestos investigation was not good for business.
  • Heitzman said he remains concerned for the workers who removed the asbestos during the Equitable's renovation, apparently without proper training or equipment.
  • "I remember seeing these kids running around furiously hauling the stuff out of here in street clothes," he said of the workers who removed asbestos at Equitable.
  • Last year, the Iowa Occupational Safety and Health Bureau fined Oakmoor Management Co./Equitable LP $10,175 for failing to have a trained supervisor at the asbestos removal and for failing to properly equip and train workers.
  • In an interview last year, Knapp downplayed the discovery of asbestos during the project.
  • It's just minute."However, state tests from fall 2007 showed there was a considerable amount of asbestos material.

A Town Called Asbest Welcome to a town devoted to churning out…

admin — Tue, 05/05/2009 - 15:00

  • That evening, I had dinner with the editor of a local paper in Ekaterinburg, the nearest big city to Asbest, and I asked him what he thought of asbestos—was there really an anti-Russian conspiracy.
  • Here, things have been hard for years, what with the European Union and the United States banning the use of asbestos in most new products around two decades ago.
  • He eyed me with suspicion and seemed to hold me personally responsible for the "Western conspiracy" against asbestos.
  • After all, two-thirds of the world still uses asbestos—it's only the United States and most of Europe that have banned it.
  • In the ramshackle office that passed for the local television studio, Andrei had clearly noticed that despite his half-hour lecture on the benefits of asbestos, I was still a skeptic.

  • McLean tendered document after corporate document that he says prove top brass had in-depth knowledge about the health hazards of Libby vermiculite products.
  • The documents n mostly corporate memos n reveal a bank of company knowledge, McLean said, and show how Grace went to great lengths to maintain "the secret."The secret was that Grace officials knew their products released deadly concentrations of asbestos fibers, even though they contained very small amounts.
  • One prevalent brand of attic insulation contained asbestos levels within the regulatory guidelines, and was installed in at least 10,000,000 homes across the country.
  • The charges relate to whether the company and its top employees knew they were endangering the community of Libby by mining asbestos-laced ore, and whether they did so in violation of federal law.
  • The lawyer ticked through the examples alleged misconduct, accusing prosecutors of cherry picking Libby air samples that contained the highest levels of asbestos fibers in order to misrepresent the actual scope of contamination.
  • "This is not the way justice should work in America, this is not it, and your verdict should reflect that."Attorney Thomas Frongillo, who represents Bettacchi, talked about the extent to which government agencies knew about the asbestos contamination in Libby.
  • McLean conceded that the EPA knew Libby vermiculite contained tremolite asbestos, but insisted that Grace repeatedly lied about the safety of their products.
  • "The reason this was dangerous is because they continually told the EPA that their materials have less than one percent asbestos, that they are not a problem," McLean said.
  • That's when the contamination was discovered in Libby, triggering a five-year statute of limitations.

Asbestos remains hazard in schools

admin — Mon, 04/27/2009 - 15:00

  • Seussical scareMost Bucks County public schools - especially ones built before the 1980s - contain some asbestos materials such as pipe insulation, floor or ceiling tiles, according to a survey of local district administrators.
  • Typically, they happen because contractors don't ask about the school's asbestos plan, Schwebel said.
  • Materials containing asbestos, a potentially hazardous mineral that can cause serious lung illnesses if inhaled, shouldn't be disturbed without involving an asbestos expert, according to the U.S.
  • In all of the recent incidents, air quality tests found no asbestos fibers present, according to district officials.
  • Complicating matters is that asbestos-related health problems can take decades to develop.
  • A chest X-ray can't detect the presence of asbestos fibers, but it can detect early signs of asbestos-related lung diseases, according to the EPA.
  • The Centers for Disease Control and Prevention, the American Cancer Society and the Occupational Safety and Health Administration haven't established minimum safe, non-occupational asbestos exposure levels.
  • That no fibers were detected is significant because, even if workers cleaned the debris and dust, asbestos fibers are lighter than air and would remain airborne for up to three days, Schwebel said.

  • and several former executives hid the health dangers of asbestos dispersed in the northwestern Montana town of Libby.
  • The dismissals leave three former executives and the Columbia, Md.-based Grace as defendants in the case tied to the company's mine where vermiculite laced with asbestos was extracted.
  • Lawyers for some Libby residents blame asbestos for sickening about 2,000 people in and around the community, and for the deaths of about 225.
  • Defense attorneys on Wednesday tried to disprove allegations that Grace executives conspired to hide asbestos risk from government investigators and the public.
  • Randy Geiger, a former industrial hygienist for Grace, listed numerous steps the company took to reduce workers' exposure to asbestos dust, including expensive ventilation systems and "supersucker" vacuum cleaners.
  • Environmental Protection Agency, methods imitating normal human activities that commonly disturbed the vermiculite in Libby.
  • The prosecutor also noted that the ventilation systems, while effective in curbing workplace exposures, merely spewed the asbestos fibers outside into the ambient air.

  • Aging asbestos crumbled and released fibers in the air.  Breathing this air over time resulted in asbestos fibers becoming embedded in lung tissue causing serious lung diseases.  In 1989 the use of asbestos was restricted.

  • Asbestos has previously been linked to an increased risk of lung cancer, mesothelioma, and asbestosis (a chronic lung disorder).
  • This study specifically looked at four North Carolina plants that produced textile products with chrysotile asbestos—the most commonly used form of this industrial fiber.
  • Amosite and crocidolite are two lesser-used forms of asbestos.
  • Past studies had raised questions about the potential of these different asbestos fibers to cause cancer.
